Terms of use
These terms of use govern the use of pegnitz.city. They apply between you and XBANQ® GmbH as soon as you use the platform through its signed-in functions (e.g. “Your dream”, personal mentor, City Talk). The privacy policy remains additionally applicable; for AI functions the AI register.
Provider & scope
The provider is XBANQ® GmbH, Neuhofer Weg 2, 91257 Pegnitz, Germany. Managing Director: Daniel Boran. Authorised signatory: Karolina Parot. Commercial register: Amtsgericht Bayreuth, HRB 7639. VAT ID: DE351031667. The complete provider details are in the Legal notice.
pegnitz.city is an independent research and technology project by XBANQ® GmbH and is not an official service of the Town of Pegnitz. Use incurs no costs for you: the account and the functions described here are free of charge. This is not a contract for a service against payment (see also Right of withdrawal).
What the platform does
pegnitz.city turns a town's scattered, publicly accessible knowledge into a living knowledge intelligence: researched, structured nodes about institutions, places and organisations, checked against real sources. Added to this are functions for citizens:
- Your dream → plan → delivery: you can describe a dream for Pegnitz, sharpen it with a private mentor and, once released, log it as a verified node in the knowledge intelligence, so that a dream can become a traceable plan.
- Personal mentor: a private, client-side encrypted agent that accompanies you without deciding for you. You decide, you own and you sign.
- The crew: a transparent view of which agents are doing which real work right now (transparency by design).
All these functions are AI-supported and are released by humans (human at the wheel). For structured knowledge the source obligation applies: no statement without a verifiable source. There are no automated decisions with legal effect concerning individuals; details on models, data and risk classes are in the AI register.
Registration & account
Authentication is by email address and password. You provide truthful details on registration and are yourself responsible for keeping your access data secret.
Minors: Registration is possible independently from the age of 16. For users under 16 a verifiable consent of the person with parental responsibility is required (GDPR Art. 8; German threshold 16). This consent is checked technically fail-closed: where age is undetermined, nothing is stored. In public views the identity of minors is reduced to a pseudonym and a coarse age band.
The account is free of charge. Use gives rise to no contract for a paid service; such a service is not currently offered.
Your duties as a user
- You use the platform exclusively for your own, lawful purposes.
- You do not enter special categories of personal data (GDPR Art. 9, e.g. health data) and no personal data of third parties.
- For content you contribute, you warrant that you hold the necessary rights and infringe no rights of third parties (e.g. copyright, trade-mark or personality rights, the right to one's own image).
- You comply with applicable law and with these terms of use.
Prohibited use
The following in particular are not permitted:
- distributing illegal content or content relating to hatred, incitement, violence or sexuality;
- depictions that endanger minors — such content is, where UGC switches are enabled, held back fail-closed and reported in accordance with applicable law;
- entering personal data of other people without their authorisation;
- bullying, harassment, doxxing or deliberately exposing others;
- spam, bulk and repeated postings, fraud as well as automated mass queries;
- the attempt to circumvent security measures, access restrictions or moderation gates.
Contributions from citizens are as a rule stored with origin: 'citizen' and moderation: 'pending' and are public only after editorial release — nothing is published automatically. Note on City Talk: public posting and the uploading of media are currently disabled fail-closed; the applicable community rules will be added here as soon as they are released.
Rights in content & consent to processing
Your content stays yours. For what you enter as a dream or contribution, you grant XBANQ® GmbH merely a simple, free-of-charge licence of use limited to the operation and presentation of pegnitz.city (technical storage, display, moderation, checking against sources). No transfer of ownership takes place and no commercial exploitation; the licence ends when your content is deleted.
When you fix a dream, you consent — via the consent options on the “Your dream” page — to pseudonymous processing in the knowledge intelligence. This consent is voluntary, revocable at any time and graduated: you decide whether your dream is processed in the knowledge intelligence, whether it is publicly visible on the dreamboard and whether it is carried anonymously or under your name. Public visibility arises only if you permit the corresponding visibility and an editorial review has been passed.
Availability & warranty
pegnitz.city is a research project. We endeavour to run a stable, secure service and check structured statements against real sources. Despite careful checking we accept no warranty for the currency, completeness and accuracy of the content. We accept reports of errors and examine them. Short-term disruptions, maintenance work or the deactivation of individual functions may occur.
Limitation of liability
As far as legally permissible, XBANQ® GmbH is liable only for intent and gross negligence. For free-of-charge use, liability for slight negligence and for indirect damage, data loss or loss of use is limited to the extent permitted by law. Statutory liability for representatives as well as any liability under the Product Liability Act remain unaffected.
User content & indemnification
Content you post is your responsibility. pegnitz.city stores third-party content as a hosting provider and is not responsible for it before gaining knowledge of it. As soon as we gain knowledge of unlawful content, we act without delay. You indemnify XBANQ® GmbH against third-party claims based on an infringement of rights or of applicable law by your content.
Changes to these terms
Substantial changes to these terms of use are announced in advance in a comprehensible and unambiguous way. If you do not agree with a change, you can delete your account at any time — that is the simple termination of this free relationship.
Applicable law & place of jurisdiction
German law applies, subject to the mandatory consumer-protection provisions of the state in which you have your habitual residence. If the dispute involves a consumer, jurisdiction is governed by the general rules; for merchants without a general place of jurisdiction in Germany, Bayreuth is agreed.
Dispute resolution (§ 36 VSBG)
The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. We are neither willing nor obliged to take part in dispute-resolution proceedings before a consumer arbitration board.
Severability clause
Should individual provisions of these terms of use be or become invalid or unenforceable, the validity of the remaining provisions is unaffected. The invalid provision is replaced by one that comes closest to its economic sense.
